1.CONTRACTUAL AGREEMENT

1.1. Validity of GTC

These General Terms and Conditions (GTC) apply to all contracts including the obligation to pay a contribution concluded between Daria Sayapina and studio members, unless otherwise agreed in individual cases. Members are individuals authorized to use one or more fitness studios (hereinafter referred to as Studios or individually Studio).

1.2. Conclusion of Contract

A member may choose between the offered initial contract periods and one of the payment methods when concluding the contract. The member shall first provide the Studio’s employee with the identification details necessary to conclude the contract. The contract becomes valid from the moment of payment for the future visit to the studio. Alternatively, the contract can also be concluded online on the website booking system https://booking.reservanto.cz/Modal/?id=21028&fbclid=PAAaZLJagd_jbim2UUZIlcqJuL6ppJbSaDaq7fxuIq8Tc-N1aC7hmFnX_FfK8_aem_ATxQv0ooooqGD4tFemULSLsuBgHYPFtZiCMxL5HyqVHuTrdkZvQcTu7orLOuVqAuOqE. In such case, the contract becomes valid once Daria Sayapina confirms its conclusion to the member via email.

2.USE OF THE STUDIO / ADDITIONAL SERVICES

2.1. Scope of Studio Use

By concluding the contract, the member gains access to one or more Studios and is entitled to use them during the respective period.

All classes take place in a specially equipped studio located at: Francouzská 31, 12000, Prague 2. There is no wheelchair access.

2.2.1. Operating Rules

Daria Sayapina is authorized to establish the operating rules of the respective Studio, which are binding for members. The operating rules include provisions regarding the permissible use of equipment/Studios and the protection of the rights of other members. They also apply to contractual partners whose Studios the member is authorized to use according to the membership agreement.

Instruction is provided in the form of individual and group lessons.

Group lessons are organized as courses, which typically last one calendar month; in exceptional cases, a course may extend to two months.

Reservations and payments are conducted exclusively through the booking system. Courses are designed as a comprehensive program focused on the deeper development of technique and the personal growth of participants. For this reason, it is necessary to purchase the course as a whole. Individual lessons from a course cannot be purchased separately.

Single attendance is allowed only once, in the form of a trial lesson, which is available at the full price of one lesson.

Once a course has been purchased, the payment is non-refundable.

Refunds for a single trial lesson are possible only if the lesson is canceled at least 24 hours prior to its start. In such cases, the amount will be returned as credit to the participant’s personal profile in the booking system, which can subsequently be used to reserve another lesson. The monetary credit in the account is valid for a period of six (6) months.

Individual lessons are conducted based on a personal agreement with the instructor, at dates and times convenient for both parties.

Reservations and payment for individual lessons are made via bank transfer to the account of Daria Sayapina.

Cancellation or rescheduling of an individual lesson is possible no later than 24 hours before its scheduled start.
In case of rescheduling, the lesson must be attended within six months from the payment date.

Individual lessons can also be purchased in a package of four (4) lessons.
The package is valid for six (6) weeks from the date of purchase. Rescheduling of individual lessons is only possible within this validity period.

As the classes are conducted in mini-groups with a maximum capacity of 4–5 participants, priority is given to course registrations. In the event that a participant registers for a first trial class but the course capacity has already been reached, Daria Sayapina reserves the right to cancel the reservation with a full refund, or alternatively to offer rescheduling to another date and time. Notification of the cancellation will be sent using one of the contact details provided during registration.

2.3. Authority to Give Instructions

The attending staff is authorized to give instructions if it is necessary to maintain the proper operation of the Studio, order, and safety or to comply with the operating rules. These instructions must be followed.

2.4. Class Replacement

In the event of an instructor’s illness or any other unforeseen circumstances, Daria Sayapina shall have the authority to replace any scheduled class with any other class from the Studio’s offerings.

3.MEMBER’S OBLIGATIONS

3.1. Email Address Disclosure / Changes to Membership Details

The member is required to provide Daria Sayapina with the current email address when concluding the contract, through which communication with the member can take place. The member expressly agrees that statements important from a legal perspective (e.g., contractual documents, reminders, statements about changes in General Terms and Conditions) may be sent either in writing by post to the postal address last provided, or electronically by email to the email address last provided.

3.2. The member must immediately notify of any changes to relevant contractual details (in particular, names, addresses, email addresses, bank connections, etc.).

3.3. Consumption Prohibition / Prohibited Items

The member may not smoke, consume alcoholic beverages, or intoxicating substances in the Studios.

Furthermore, the member may not bring into the Studio prescription medicines not intended for the personal and medically prescribed use of the member, intoxicating substances, and/or other substances enhancing the member’s physical performance (e.g., anabolic steroids), and alcoholic beverages. The member may not offer, procure, transfer, or otherwise make available the aforementioned substances in the Studios, whether for a fee or free of charge.

4.1. Method of payment. Due date for monthly fees.

Payment Systems: trial lesson,  as well as courses, can be booked and paid for through our reservation system (by card or bank transfer):

  • Trial lesson: Reservations and payments are managed through the system. Trial lesson is available at the full price of one lesson.
  • Courses: Payments are made through the system and are subject to the terms and conditions specified for the particular course.

4.2. The price of trial lesson or courses is listed on our online reservation system HERE

4.3. Right to adjust the price

4.3.1. Daria Sayapina is entitled to increase the monthly membership fee, and will exercise the right to increase the price by a declaration in written form. The price increase shall be effective from the first day of the month following the delivery of the declaration.

4.4. Delay in payment. If a member is late with payment, Daria Sayapina reserves the right to invoice the member for late fees if the delay was caused by the member. In addition to late payment interest at the statutory rate, the member shall also be liable for the costs of legal enforcement appropriate to the purpose, including expenses associated with reminders and collection, court fees, and legal representation costs.

  1. DURATION / TERMINATION / WITHDRAWAL / SUSPENSION

5.1. If a member (consumer) concluded the contract online, the general right to withdraw from the contract within 14 days pursuant to § 1829(1) of the Civil Code does not apply to courses with a fixed schedule and reserved places in accordance with § 1837 of the Civil Code. Upon payment, the participant’s place in the course is firmly reserved and non-refundable, unless explicitly agreed otherwise.

5.2. For the purpose of exercising the right to withdraw from the contract, the member must inform Daria Sayapina of their decision to withdraw from the contract by means of a clear statement (e.g., by email or letter sent by post). To comply with the withdrawal period, it is sufficient to send a notice of the exercise of the right to withdraw from the contract before the relevant deadline expires.

5.3. Suspension of the contract

5.3.1. Courses:
Cancellations for individual course lessons must be made at least 24 hours in advance; otherwise, the lesson will be charged.

Make-up lessons can be attended by joining another class, subject to available spots, and only within the current month of the course.

Within each course, every participant is entitled to one emergency absence, which can be used even less than 24 hours before the lesson starts. In such a case, the lesson can be made up by attending another class within the current month of the course, exclusively if there is available capacity in the group.

The date and time of the make-up lesson are arranged individually with the instructor.

5.3.2. Missed Lessons Due to Illness
Considering the course duration (1 calendar month), it is not possible to freeze a purchased course due to illness during its running period.

However, in case of absence, missed lessons can be made up within the validity of the purchased course, subject to available spots in the groups. This means a participant may attend multiple lessons in a single week (e.g., 2–3 lessons in one week). If illness occurs during the last one or two weeks of the course and the participant cannot make up the missed lessons within the course validity, these lessons are considered forfeited and cannot be carried over or rescheduled in the following month.

If the illness occurs before the course starts (i.e., the participant has not attended any lessons) and is supported by a medical certificate confirming the inability to attend most lessons during that month, the course may be postponed once to the following month.

5.3.3. Individual Lesson Package – Illness
An individual lesson package can be temporarily paused (“frozen”) in case of illness, based on a medical certificate. Unused lessons can then be completed within 6 months from the date of the pause.

5.3.6. In the case of cancellation of a lesson due to the School’s fault, the client is given the option to attend another lesson, or at their request, the costs for canceled lessons are refunded or may be credited towards the payment of the next course.

5.4. Right to extraordinary termination

The right of both contractual parties to terminate the contract immediately for serious reasons is not affected by the aforementioned provisions.

5.5. Submission of termination by the member or notification of suspension of the contract by the member

Each termination or planned suspension must be sent by the member with the member’s number by post to Daria Sayapina’s address or by email to the official email address info@bodylab.space.
